These Terms of Use ("Terms") govern your access to SpeakMonk.ai and related services provided by SpeakMonk Technologies Private Limited ("SpeakMonk," "we," "us," or "our"). By accessing or using the service, you agree to these Terms and our Privacy Policy.

2. Who may use SpeakMonk

SpeakMonk is intended for school-age learners, parents, guardians, educators, and authorised school representatives. If you are allowing a child to use SpeakMonk, you confirm that you are their parent, guardian, or an authorised representative and that you have obtained any permissions required by applicable law or your school.

3. The service

SpeakMonk provides AI-supported learning experiences, including structured lessons, learning checkpoints, and progress information. Some features, including live voice interactions and human mentor support, may only be available on selected plans or during specific programmes. Features may change as we improve the service.

4. Educational use

SpeakMonk is an educational support tool. It does not replace a child's school, teacher, parent or guardian, professional advice, or any assessment required by an educational board. Learning outcomes vary with the child's participation, prior knowledge, and learning environment.

5. Acceptable use

You agree not to:

• Use SpeakMonk for unlawful, harmful, abusive, or inappropriate purposes.
• Attempt to bypass safety controls, disrupt the service, scrape content, or gain unauthorised access.
• Upload or share content that infringes another person's rights.
• Use the service to generate, distribute, or request harmful content.
• Misrepresent your identity, school, authority, or relationship to a child.

6. Accounts, beta access, and payments

Beta and early-access features may be limited, changed, paused, or withdrawn. Where paid services are offered, the applicable price, billing terms, and cancellation terms will be presented before payment. You are responsible for providing accurate registration and payment information.

7. Intellectual property

SpeakMonk, its software, lesson designs, visual content, trademarks, and other materials are owned by or licensed to SpeakMonk Technologies Private Limited. You may use them only for personal, classroom, or school purposes permitted by the service. You may not copy, sell, redistribute, reverse engineer, or create derivative works from them without our written permission.

8. Availability and disclaimers

We aim to keep SpeakMonk available and accurate, but the service is provided on an "as available" basis. We do not guarantee uninterrupted availability, error-free operation, or any specific academic result. You should independently review important educational decisions and report any concern to us promptly.

9. Limitation of liability

To the extent permitted by applicable law, SpeakMonk Technologies Private Limited will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Nothing in these Terms limits liability where it cannot be limited under applicable law.

10. Governing law

These Terms are governed by the laws of India. Courts with competent jurisdiction in India will have jurisdiction over disputes, subject to any mandatory rights available under applicable law.
